That's pretty common nowadays in the US, it's entirely legal and from the business' point of view it's a great way to get things settled. The most curious part is why Nintendo even added the opt-out clause, afaik it isn't necessary. I'd guess some state has a law for that and they settled for a blanket EULA. It's not pretty but there's no sign of it going away soon, SCOTUS has ruled that binding arbitration in place of class action lawsuits and suing is legal.

Assuming it's the US EULA, the article doesn't specify any of that.

I imagine that perhaps Sailerius didn't read anything further than the first line before he crafted his response. Kinda like in the past where he's linked to articles that don't actually back up the point he's making.

I assume they're relying on social stuff to keep it going.

Or just the Skinner box setup.
When the numbers drop off they'll release the next GSC pokemon, then RSE, DPP, etc. etc. . Maybe at some point they'll work on expanding the game past a geocaching app, I'd certainly be interested in a full bore pokemon game in the style of Pokemon Go.

(I still haven't played it, afaik it's a geocaching game so I might be wrong on that front)
