SILENT HILL ON RPGMAKER?

I've been toying with the idea of making my own Silent Hill game on RPGMaker for a while now. I've seen the engine do some incredible stuff with survival horror and psychological horror (Ib, Yume Nikki, among others), so I was wondering how hard it would be to make a game like Silent Hill. I've had a basic story in the works for about a year now, and while I was originally just going to post it, I think it would be better executed as a fully playable survival horror game. I have plenty of experience with RPGMaker and I could probably do most of what I intend to do on my own.

The questions I have are few and somewhat far between, but very important:

1: How illegal is this? If I don't intend to distribute it, even for free, will I still get a C&D?

2: Would it be hard to design the flashlight and radio? If so, how hard, and would I need a separate coder for it?

3: Should I go for voice acting or not?

Completely illegal. You probably won't get a C&D, but it's still 100% against the law.

The flashlight would be pretty easy, but you will probably want to get a script to make the radio easy to develop for.

3: Should I go for voice acting or not?

If you can find good voice actors, go for it, but bad voice acting can really ruin immersion.
Just make a silent hill-ish game and don't call it Silent Hill. Totally legal.

I've been playing around with an idea of psychological horror game on rpg maker as well. There's no way you can have the kind of immersion as some more recent 3d horror games, but if the player is willing to use his imagination and take the game for what it is, you can make something worthwhile.

Your best bet would be to make something eerie and bizarre in the same vain as yume nikki. An original idea and good imagination will take you far. Another example would be something like the original X-Com. You know something lurks in the darkness but waiting for it is worse than actually confronting it.

laws are stupid anyway.

but i certainly prefer original games to fangames and obvious clones.
