WHAT ARE THE LEGAL ISSUES INVOLVING OTHER PEOPLES MUSIC IN A NON PROFIT RPG?

Since I can't use my own music I'd like to pay homage to some music artist I fancy by adding in their music of course I fear that is illeagle though I've seen other RPG maker games do this. I figure maybe it depends on the owners of the specific piece of music like as much as I want to use it I doubt I can get by with Sense of doubt by David Bowie but I'm pretty sure there'd be no problem if I used death by Metgumbnerbone since they are obscure as hell and were arrested for grave robbing.
There has only been one game I know of that used proper real life music well in their game and that was Beautiful Escape: Dungeoneer.

That said, you while it's not legal to the letter of the law and you can be sent a cease and desist from the copyright holders if they want their music removed, it shouldn't pose a problem in theory.

Aside from the whole 'real life songs in a game breaking the immersion' thing and all.
You can generally count on it being illegal unless the artist explicitly says that you can use it (like a CC-license) or you have personally gotten permission to use it.

However it being illegal and someone caring are two completely different things. I'd say that more than half the games on this site are illegal or use music illegally, but it doesn't really stop anyone does it.

What it boils down to is usually this: It's illegal but no one cares.

You shouldn't use resources of any kind without licence or permission. It isn't hard to create and source original assets for a project.

I didn't plan on using like pop type song mainly instrumentals and ambient type stuff. Tell me this wouldn't be epic danger area music!

Shinan is exactly right. It is illegal. No one will care. Coheed and Cambria has yet to break down my door and demand I remove Iron Gaia and it has been complete and available for download for over ten years.

Metgumbnerbone were a dark ambient/tribal ritual music group from the early 80s who went grave robbing and drilled into the bones and made instruments out of them. When they were arrested they found all kinds of books on witch craft and stuff. Would explain why their music is so eerie even to me.
I've been wanting to know this, too, although I think I'm more concerned that I have downloaded the music (granted it is all old forgotten pop music from the 50s/60s).

I'll just go with "it's legal but no one cares" too, I guess.
It's only illegal if ur making a profit, I guess they could sue you for a loss sale of the song but it doesn't really matter, I doubt they're on here looking at abunch of novice and slightly advanced game makers lol.
