I wasn't sure whether to make this topic or not (actually this is my second attempt at it, the first topic I made was eated by an internal site error and RMN ate it. Thanks for that.), but I wanted to let you guys know.

I'm a member/mod of a relatively known and all the way established FFVII coverage site, called the Lifestream. We cover the Compilation of FFVIII and the original FFVII, through Ultimania and plot bible translations, developer interviews, and other projects. Our current project is the planning and development of a 25 page comic book of a scene from FFVII, drawn and written by the community's longtime member and very talented artist, Dacon. Check out the main info for it here.

We want to raise funds for the 500 bucks commission that this thing is going to take (and yeah, it's going to be an actual, physical, real deal comic), but I'm not really asking you guys for that (although it's always welcome, and once the physical comic does come out, it'll cost you some bucks for a copy yourself). One thing we COULD use help with is the voting for what scene the comic will focus on. You can vote for that yourself here, and you can check out Dacon's art here. Use the Advanced Search function to filter just Dacon's posts. He's going by the name I'm Batman at the time of this writing.

At first I didn't want to make this topic until there was something actually to present art wise, but this is a very personal project for Dacon himself, and something a LOT of other people would like to see. If we don't raise awareness for it, it might not happen the way we want it to, and it would be a damn shame if if DID happen and nobody would see it. So please, check this out and if nothing else, give this a look. I definitely plan on letting you guys know about the finished product, and I plan on buying a copy for myself.
A nice idea, but I think you might need permission from Square if you plan on using their characters, especially seeing as you're gonna charge for it.

The bottom line is: Square is not going to allow you to do this. If you do it anyway, you might want to put that $500 or whatever you get toward getting a good lawyer.

I doubt Square will really notice it on top of all of the other stuff people are doing with FFVII nowadays. I definitely think it's cool to see scenes from movies/games/comics/shows/etc I like re-imagined and reinterpreted in different ways. So far the scene thats winning the polls is the Siege of Midgar right before Disk 3. I'd love to see how he handles the fight with the Proud Clod, meeting up with the Turks, or even fighting some SOLDIERS or so. Can't wait to see the scene with the final battle with Hojo atop the Sister Ray.

Yes. All of FFVII's material is copyrighted by Square-Enix-soft. You could be sent a Cease & Desist letter for it. And I don't think whether or not you are selling it matters.

You know, you can make big money of of selling Cease & Desist letters, so that legal bill can be paid off after you win in court because of fair use and parodies and the comic not being sold for a profit and whatnot if you get a couple hundred of them. Guys quit spewing all that propaganda that twisters of the law have forced down people's throats. Though, you could always have the artist and production be moved to Spain. :P

I'm not interested at all in this personally since I only played and beat all the FF games up to the sixth, but I wouldn't want to see ya'll get scared into not doing this (though I don't claim to be an expert in the law myself, I know ridiculous when I see it).

This isn't an RPGMaker game. This is as Feld says, a well-established site that has interviewed developers from the actual game. If you're selling copies of a scene from the game... You could get a C&D letter.
A possibly unwarranted C&D letter. Just because a company sends you a C&D doesn't mean you were doing something illegal. See those high powered lasers that were sent a cease and desist from LucasFilms because there were a couple of blogs that called their lasers real life lightsabers, and how LucasFilms later realized they had no case and backed down.

Just an example. Tons of people do these things all the time, it's no big deal. You could say that by recreating scenes from the game is where you draw the line, but you're really just grasping at straws then. I'm sure Square wouldn't mind what this guy is doing.

No, it just has developer interviews that were translated from Japanese. The site itself didn't interview anyone.

Well I am not 100% since the things I linked are imports and are made from an unknown group of people, but you get the idea. I would also still be aware.
Realistically, he'd most likely fly under their radar, just given the nature companies are more worried about torrents than they are amateur comic books.

However, if he's generating an income ($500 commission fee) with an IP he doesn't own license or is under contract to, he is painting a brighter target on himself than the average FFVII fan does. Money is blood in the water for lawyers after all.

It's worth noting most publishers won't accept unauthorized content either. Deviant Art doesn't provide their print services for fan art for example. In the "real publishing world," the Publisher is the one that actually buys the license. For two reasons: they can actually afford it, and they have to anyway because they're the ones that physically reproduce and distribute the IP.

If I were him I'd accept "donations" but make the fan-comic with the intention of putting it on that website freely. The site is basically sponsoring him/giving him exposure anyway, so kinda silly to turn around and charge them again for the actual product when it's finished. Less risk involved, gives the site more content/traffic, he gets exposure, and if anyone still wants a hard copy they can print it themselves. Besides, comic's are a lot more work than people tend to think they are. It may turn out it's not his cup of tea, and he won't have so much invested in it before he pulls his rip-chord.
I remember doing concept art and a little mapping for a Half Life mod about 5-6 years ago that was based around FF. Basically, it was TF with FF-style classes (fighter, thief, black/white/red mage, etc). We got a C&D order about 3 months after putting up our website. It turns out, Square was pretty hardcore about stuff like that. Of course, things might be different now.

After that, we decided to take out all the FF material and just go with something original. Then we realized what we had really had no substance as a game; the whole thing was just sugar-coated with fanboy FF crap. The project died shortly after.

We'll see what happens. I don't think we're getting the comic actually REAL LIFE published. As far as the commission, if he's doing all the footwork, I really don't expect him to do it for free. 500 bones is a lot of cash, but if the finished product is worth that much, then well, he earned it. It's not crazy for artists to be paid for doing art, yeah?

It's just something we're/he's doing for the love of the fandom. It is a FFVII site after all.

500 bucks for 25 pages is not much. Actually, it's very little.

As for the comic itself, just treat it as fan art. As long as you don't charge for viewing it, then all is fine. Although you might not want to be so vocal about paying the artist for it.
