Out of respect for the Authors, I don't want to do that. Which in turn means that I wouldn't use any protected material if asked not to.

Everything you use that isn't made by you was made by another person.
So it's fine to use another persons work of they are doing it proffesionally (Final fantasy sprites, Disgaea sprites, pokemon sprites etc).
Just because that person isn't a proffesional you somehow have MORE respect for their work? Do you think the spriter in pokemon wants his/her sprites used without consent, just like the people making fakemon sprites doesn't?

It's that old 'honor among thieves' notion. It's easy to use ripped graphics and remain in good conscience because they were taken from a corporation that isn't likely to complain about it. But when it's from another person on the 'net who isn't profiting from their work and could be upset in a way that you yourself see, it's different. You're less inclined to use someone's work when you can see the negative effects, even if it's just that person getting mad at you.
Given that this is meant to be a side project, rips would be the way to go imo. Some people may have the talent and imagination to sprite up 150 unique monsters no sweat, but that's a serious time investment for others. The tradeoff with using rips is the big chunk of time it'd take to make them vs. alienating part of your potential audience. As some have said, they'd be disappointed to download a Pokémon game that isn't like Pokémon at all.
Ultimately, Jparker, you're allowed to do whatever you like with it. Just keep an open mind, hear out advice, and decide for yourself what's best for your project.

I got a number of useful tips from the thread, I think I've gathered enough info for now. I got a basis for how I'd like to start it out.

But here is the thing, it will prob be hard to find monsters and monster character sprites to fit the pokemon style maps and what not.
The thing is, if the content of your game isn't centered around catching monsters and fighting themed gym battles to win a championship, why call it Pokemon?
From the sound of your idea, you don't even need to use the existing pokemon franchise to make it work, maybe create your own species.

I mean, I supposed I could sprite up some Dragon Warrior monster graphics. Though, that would take ALOT of time and I'm not even sure that would work. The reason I wanted to use Pokemon is becasue I grew up loving it and I wanted to make a kind of Disgaea type aproach (story and writing stlye wise) to Pokemon. Giving a cool twiist to a childhood memory.
If I recall correctly, DQ Cursed King had a monster capture system. I think this would be a better idea than hanging on to Pokemon's coat tails. Develop a concept, where maybe you have Pokemon as the enemy (or a parody of them), but with usable monsters that can combat them from maybe a different universe.

Im a huge fan of the DQ series, I never thought to check out that game. Good idea.
