GAME 'PUBLISHER' PM SPAM

Many of you probably received some kind of PM last night/yesterday about a deal with a studio.

The person in question is a known spammer and was warned for doing the same last time they were on the site. They have been banned for this again (their ban expired) and had their duplicate account banned as well.

Whether you decide that their offer is for you or not is up to you, just keep in mind that they chose to spam a great amount of people the same offer and thus it is not your particular game that they care about - they just want money.

There are many ways out there to publish your own games. Just think on if you want your game tied up with the name of a company who does these kinds of practices and have a wholesale strategy for every game, not taking into consideration the personal aspects of the game itself:
- They do not check for rips or non-commercial material before offering you a publishing deal (apparently they assure me that they do check after they do the spam for interest trick but who knows? Just keep in mind that this can be dangerous for you.)
- They do not take into consideration whether a game is finished or not
- They do not take into consideration the length of your game
- They do not take into consideration whether your game is all custom assets or a mix of RTP/free resources

(I have since been told they customise afterwards based on details but frankly the first offer is pretty terrible representation-wise. That and they have some contractual details that are not great for people who want to maintain and continue work on their projects. Basically, if you like your game and want control over it when it comes to choosing where it's published, they probably aren't the right fit for you.)

They do not care about your game personally, instead sending out a bunch of PMs in order to catch a quick hook. Fly fishing, basically. Quick spammy casts to catch the attention of unwary 'fish'.

Think long and hard before deciding whether you want to trust a 'company' that works that way. Take care of yourselves when it comes to business practices - usually the easy and fast deal has a lot of issues that will make you regret.
Very few things in this world are simple or easy.


Also, if you do decide to take up with them get someone who is on your side legally to take a look at the contract to make sure it fits your desires when it comes to what you want from your game. Don't get caught out by a pretty by-line or the lure of fast, easy cash.

This is a thing that happens? Also, does sueing for defamation ever work anyway? It seems to me it clashes with free speech 99.9% of the cases.

Defamation, from my (limited) knowledge of the legal sense, is the use of false information to damage or destroy the good reputation of an individual or group, similar to libel or slander. The keyword here is false. Free speech doesn't apply when making stuff up to attack someone's character.

Doesn't matter anyway, since the defamation claim wouldn't hold water in this case.

Most lawsuits like this don't hold water, they aren't meant to. They're meant to drain the cash of the defendants until they have to settle or go bankrupt. It's a SLAPP lawsuit with a specific purpose and why national anti-SLAPP legislation is necessary to end this bullshit.

The owner of RMN lives in Canada so winning in the USA might not amount to much.
It was a scam?!?! I never knew and here I was so excited about the idea that I asked them to have my babies... my heart is broken... life is truly over!

I wouldn't say it's a scam, I'm just pointing out that someone who spams everyone on a site may not have the best of business practices when it comes to publishing games. I know they've published some games before, however the fact that instead of actually asking after specific games and instead throwing out a bunch of lines to anyone at all doesn't really indicate that they really care about your game.

That said, they have a few bits in their contracts that can be considered a little hokey, so I highly recommend that if you do think about going forth with them, you get someone with legal knowledge to look through any contract before you sign it. At least one part states that they basically own the rights to where your game is published, which isn't great for any developer who actually has a game they care about.

Just tread very cautiously. This thread is basically to let people who might be suckered in by a pretty by-line stop and think for a moment about what they're doing. Also to inform that they have been banned for breaking the rules yet again. (They were banned for the same behaviour before. They've now been banned again for it, this time for much longer.)
I have been asked by the Publisher to stand out on here to clear confusion

I can say I have had my game Warriors of Vilvatikta published by the publisher in question and I can say no comment like that is in the contract.

I have always been paid on time and I completely own the IP for the game

The Studio are a good bunch of people and are hard working had no issues with them to be honest

@RPGVIDEO: Well, that's good and all, but that's not really the point. The point is that spamming people's inboxes with promotions is something people tend to scoff at. If you want to promote, sure, but at least do it discreetly. Post a proper topic on the forums, for instance, and not invade into people's privacy by spamming their inboxes with PMs.
That aside, I did edit to update the information given about the whole "We do allow you to maintain rights to your work" since that's fair enough. That said, as eplipswich said, the big issue is that you spammed people again, after the last time being banned for doing the same thing. That speaks wonders for your work and business ethics.

The fact that they've broken site rules multiple times (this isn't the first time they've sent mass-PMs and been banned for it, plus the multiple sock-puppet accounts) speaks to their lack of integrity. If anyone's considering working with them, ask yourself this: If they aren't even willing to follow site rules, what are the odds they're going to keep to their word about what they are promising you for your game?

Don't fall for this crap. Everyone here deserves better than that.

I messaged him back about one of my games to see what would happen, but I can say I don't trust the guy. Good luck to anybody willing to sign the contract for their game.
I just asked him to have my babies because I was so excited. His response was that I needed to have 100% rights... felt a bit botty so I ignored it. Now this Adam guy under rpgvideo is messaging me I told him I wanted Jonathan back. Does this make me a troll? Can you troll a spammer, is that a thing? I suggest we start an occupy Jonathan protest!

Doesn't mean anything if another part of the contract gives the rights of the game to this spammer as that would make them the owner/rights holder in the other part of that equation. Just saying...
