Only if they sign over the ownership and even then it's theirs. Consider - photographer takes photo then sends it in to a competition to publish it in a magazine. The photo wins, gets published. Ownership belongs to the photographer even though they allowed it to be distributed. There's an expectation that the photo be allowed to be published in that magazine - that was part of signing up for the competition - however after the competition ends that photo is still owned by the photographer.

If someone took a photo they own it, unless it was taken in a business transaction on behalf of a company. For example, a photographer was hired to take photos of kids at a school. The ownership of those images becomes school property and the property of the kids/parents, though the photographer is allowed to point out that they took the photos.

It's very dependant on copyright laws in your country but for the most part, the creator of the content holds some rights to it unless they sign those rights away, and even then you can't say 'Oh, I got Gant to take these.' when it was Eddy who took them. The name remains attached (like telling someone the Mona Lisa was painted by Jack Sprat).

In the case of someone taking a photo of themselves, it's doubly theirs because not only is it their creation but it is also of their own body.

Now there are criminal laws against taking photos of minors and stalking and the like which removes your rights to the photography in question, too, which is something to consider but for the most part copyright stays with the creator at least in some way, shape or form.

Even if a woman gave consent to be video taped while having sex, she would also have to give consent to have it loaded onto the internet. I mean she could have a good civil case against this guy for loss of money due to harm to her reputation, as well as any foreseen money that was made as a result of the said video. I mean with a good lawyer she could ruin this guy financially.

besides, you wouldn't want a law specifically making accidental 3rd party death from ax juggling illegal since it'd already fall under manslaughter.

I'm quite sure the people who are paid to perform such death-defying acts sign waivers so that - in the case of a fatal emergency - the company is not to be held responsible. The life insurance agency handles the grey area. It's a risk of the profession.

Also, another reason why we should allow these threads to exist and give the administrative staff some props here on RMN is because, at this moment, elsewhere, a thread as simple as this was locked without anyone else getting the chance to respond beforehand because it's... well, just see yourself:

This is not the proper community to have discussions that topics such as this have brought up. While posts were not inherently bad in nature, it is not content that we feel comfortable being discussed here.

We do make exceptions in some cases but we try not to allow stuff that's too explicit (or, really, explicit of the sake of being explicit) on site. That's why games that allude to things like rape, violence, torture, etc are fine as long as they don't get too detailed, though again we do make some exceptions in the case that the subject in question is handled respectfully.

Judging from this topic thread, this was not handled very well.
