Because using that skill costs you nothing / you start with this skill.
Later when you level up and have MP you can improve your odds.

Thievery costs 1MP, has 50%, and deals damage.

Edit:

Chances also depend on item. So some items are really easy to steal.

To fix upscaled problem go to photoshop and resize into 200% on the nearest neighbor setting :O it will be slightly pixelated but it won't blur since it's using a resize method that retains the pixels V_V
