Same-sex marriage must be banned, appellants argue, because same-sex couples are not naturally procreative. But the state permits many other types of non-procreative couples to wed.

As are opposite-sex couples who choose assisted reproduction. See §§ 78B-15-701 to 707 (providing rules for parental rights in cases of assisted reproduction); §§ 78B-15-801 to 809 (providing rules governing gestational agreements).

I'll leave my opinion on same-sex marriage out of this (as to not start a flame war or something) ;however, when the founding fathers were writing the constitution, I don't think they had homosexuals in mind. What that means: well, I'm no quite sure.

MajoracanKing, contrary to your flawed belief, many of the Founding Fathers were not devout followers of Christianity. And homosexuality wasn't a big or important thing at that time as it is now. They did not write it with the Christian population at mind. So don't you dare use the Founding Fathers as an excuse for your homophobia.

Wow man, I didn't mean to offend you or anyone or that matter. Not to mention you kind of assumed a lot of things. I'm not homophobic, I've got plenty of homosexual friends. Also I didn't say anything about the founding fathers religious beliefs, nor did I believe what you thought I did.
Maybe they didn't cover marriage specifically, but not allowing same-sex marriage is considered unconstitutional. Thus, the rights we are given are said to have intended (or otherwise) to protect homosexual marriage.

The founding father's religious beliefs shouldn't matter at all, the USA was intended to have a secular government. Article 11 of the Treaty of Tripoli, signed on 1797 by John Adams with unanimous consent by the senate, reads:

Actually using 18th century morals in a 20th century world is really dumb and the way some Americans fetishize their founding fathers as ubermensch is genuinely disturbing. An extreme example would be trying to apply Deuteronomy 22:28-29 today which has no place in modern society.
I am aware too that article 11 of the Treaty of Tripoli says something different in the original Arabic the English version was translated from and the 1805 treaty that replaced the ToT doesn't have that kind of language at all. I think it's unfortunate.

Yeah, the Founding Fathers religious beliefs, notably the lack of them or the desire for a secular government, is relevant. As it led to the creation of an intended secular government. I am loving all that you've been linking GRS though!

The common belief among the Founding Fathers was Deist. It's exactly what it sounds like; the belief that there is a god but that he, she, or it has never been described by a specific religion. Read "The Age of Reason" by Thomas Paine. Among other things, this pamphlet discusses the truth of religion, challenging institutionalization of religion and the authority of the Bible. It criticizes the Christian Church's political policies (the very idea of a church seeking political power should be offensive to any reasoning man), and elucidated what Paine saw as corruption within the church.
The Age of Reason does not dismiss god or any type of divine entity, but wisely suggests that we favor logic over blind faith. The Age of Reason was a best seller in the United States and caused a Deist revival. Yes, there was a time when this nation was one predominately of intellectuals. Much of that still exists today, but is drowned out by the stupefying force of mass media.
Thomas Jefferson kept two books in the drawer of his office: the Bible and a scrapbook. He would cut out scriptures from the Bible that he agreed with, paste them into his scrap book and discard what he did not agree with.
What is truly disturbing is that so many people accept point blank that this country was founded by Christian men upon Christian principles. This not only suggests the typical ignorance found among the blindly faithful who would even resort to the most horrendous forms of violence to make this nation solely Christian, expelling any who did not absolutely believe the word of god, but suggests a concerted effort to expunge and hide the historical record. Anyone who took a social sciences class in the 90s knows our Founders were not Christian and believed that we should have the freedom to worship as we saw fit.
