He used code stolen from TDS to make the game, so it's likely the answer was the latter at this point.
If anyone has ever downloaded or played any of his projects I'd recommend running an adware or malware scanner.

And not liking the music at all. It's terrible. The original was great because it was the perfect amount of balance - this one is all riffs and guitars and mental. No balance at all. >.< He ruined good music.
My lord, the battle music alone was just so epic. It still invokes in me such a heroic beat, and makes me want to jump in and beat down every villain.

It also reminds me of some of some of the classic animes during that era during some of the more intense action themes, which is probably what they were going for since anime seemed to really find its foot amongst the US market in the mid 90s. I couldn't look anywhere without an anime advertisement.
I don't watch as much anime these days (still trying to carve out time to watch my Ys Collection), but I can still appreciate the music of the SNES.

I actually found the guitar lead in the remix of that battle theme to sound pretty good; he really just needed to boost the volume on his synths. I'd probably toy with the drums a bit, too, but that's personal preference. The graphics are really a step back, though.

I mean, from what I learned about con artistry by watching Burn Notice, I would say that sticking to his guns is the way to go. People's suspicion certainly isn't going to be alleviated by him changing his story.

Obviously, this dude is hilariously scummy and deserves all of the lambasting he's getting. On one hand though, you can't knock his hustle. This shit is what bad-but-lucrative salesman dreams are made of.
