Maybe a more proper way to say it these days is to say it's a "Spinoff". It retains some stuff from the original and mentioning someone's name in passing is not illegal. (though they can always put in the "any relation to actual persons living or dead is purely coincidental")

Well, that sucks. The guy is 500 bucks richer, a lot of people have basically thrown their money away, and the project goes in the trashbin. Thanks a lot Kickstarter!

I would consider it pretty basic stupidity to not even research the tool that was used to create something, really. Especially if the person claimed to have put so much work and effort into it.
Really, how could you look at something like Unemployment Quest and think to yourself that it was really hard to make? It doesn't even look professional. At all. Something has to click in your head that says "this looks shady".
