The site may not 'host' illegal files, but it provides extraordinarily easy access to pretty much any kind of illegally obtained software you can think of. Not actually hosting the files is, frankly, a bullshit argument that only a kindergartner should or would buy, akin to stingy Americans finding loopholes in order to avoid paying the guv'ment taxes or some shit.

thanks for your ad hominem buuut as I've already said this is specifically addressed by EU copyright law. it is the difference between legality and illegality.

I just don't buy them not actively promoting piracy. If they didn't want to be associated with it they shouldn't have worked at The Pirate Bay in the first place.

promotion of piracy or indeed of anything else cannot be a criminal offence in any country or conglomorate that adheres to the UDHR so this is bunk already.

Again, you are hiding behind the minute technical details of how a torrent works and ignoring what that actually means in the real world.

The "torrents of illegal files aren't illegal files themselves" excuse is perhaps one of the most ridiculous excuses that those engaging in piracy are making. It's a terrible parsing of words, especially when the end result is the same.

Are you sure you know how most legal systems works? They don't worry about the minute details of the technology. They worry about the end result.

though the end result here is other people committing software piracy, this doesn't actually criminalise the actions of Neij, Svartholm and Sunde (never mind Lundström for now) for what is simply providing the contact details of file sharers. thanks for your mockery too but okay.

Owning a gun is not bad. Owning a murder weapon is. It's the same with torrents. Downloading a torrent of a linux distribution is great. Downloading a torrent of Windows Vista or Adobe Photoshop is piracy. Again, it's not the torrent itself that is illegal, but rather the act that the torrent enables.

kind of covered this already but this has no bearing on the activity of Neij, Svartholm and Sunde because not one of them has either produced nor actively distributed copyrighted materials by making available the material itself (this is explicitly stated in European Union copyright law of which, of course, Sweden is a part of, and which takes precedent as a condition of membership). remember, no material is hosted at TPB!

The Pirate Bay and other organizations have a responsibility to ensure the torrents they list on their websites are legal. They don't, and in fact do quite the opposite.
no and very no! they have no obligation to do anything of the kind (witnessing and ignoring a crime is not a crime in itself), and they certainly do not deliberately list only the details of illegal material. in actual fact there is both law and legal precedence that state this protection from liability.

long story short: none of the three main defendents have committed legal wrongdoing. they have not reproduced, solicited or even turned a profit from copyrighted material, as money paid to Carl Lundström for his services (servers and bandwidth) or for the domain does not constitute profit. enjoy finding what criminal activity they have actually undertaken! (I bet they have taped off the television at least once)

longer story shorter: trial is a shambles. poor consideration of the actual nature of their activity, and they were tried wrongly as an organisation even though the four men are nothing of the kind. the European court is going to enjoy this one.

tl;dr: richard kimble didn't do it it was the one-armed man!

a lot of herbal remedies are anti-inflammatory (i.e. they treat the symptoms, inflammation of the skin around the blocked pore, rather than the cause, pore blockage) but most are either unproven or have no effect!
