I'm sure ISPs keep a log of their access records for maintenance purposes and that nothing will probably change in practice with this new mandate. However, I can't see the US government using the new provisions for anything productive from the PoV of the ordinary citizen.

I think there's still lots of compromise to be made. Like all that stuff about immunity to service providers for taking voluntary action? That's just just asking for trouble... But to completely do away with the bill and start over? I'm not sure how that will fare any differently. Specially when the "consensus opinion of the American people who absolutely reject SOPA/PIPA" is already so stigmatized. They won't accept anything as long as it messes with their precious Internets. No matter what it includes, no matter how it is worded.

There can't and won't be any compromise on SOPA/PIPA because the bill wasn't drafted in good faith. Nobody other than the media industry had any say during the drafting of the bills, other interest groups like IT companies were not involved in the drafting proceedings. Add to that repeated refusals by the House Judiciary Committee in regards to demands from IT companies and other interest groups that their voices be heard and considered (the first committee hearing) and repeated refusals by the Committee to accept amendments to SOPA that were trying to fix problematic provisions (the second committee hearing), it is pretty obvious that SOPA/PIPA was not drafted with the intent to hear input from all sides of the table and that it is primarily intended to answer the demands of Hollywood at the cost of everyone else.

Also, drawing fanart has always been considered an infringement of Copyright laws. All that SOPA does is changing is the sentencing guidelines for that kind of stuff. (If I'm reading the bill correctly) But the point is that no kid as been sent to jail for it before, and no kid will be sent to jail for it after -if- SOPA passes... And where do you get that SOPA does away with "Fair Use"? Where's the language on the bill that implies that? I think this fear comes from the fact that 'Fair use' is already vague enough on it's own and people ignore that.

SOPA/PIPA does away with the Fair Use clause (and any other potential safe harbors past, current, and future) through its provision that shut downs only require unsubstantiated accusations of copyright infringement.

For example, you could take a screenshot of Final Fantasy 8, use it in a review of Final Fantasy 8, and claim that it is used under the Fair Use clause to illustrate something, but SquareEnix can just ignore your claims and accuse you of copyright infringement without needing to prove that your screenshot does in fact violate Fair Use and infringe copyright and both you and the website hosting your review would be subject to take downs and arrests.

The almost limitless powers that SOPA/PIPA gives to copyright holders, effectively turning them into the internet police, is the crux of the problem.
I hate to open a technical can of worms here but I have a few thoughts on this whole thing. When you go to a site on the internet a picture of it goes on your temporary internet files. Thats how they catch a lot of child porn. According to SOPA/PIPA any copyrighted picture thats on your computer which you don't have a right to according to them you could be prosecuted. In other words every computer thats been on the internet would be in violation of SOPA/PIPA because of the temporary internet files. You have to format your hard drive 7 times to make sure you don't have anything left on your machine. Deleting anything once will not do it. They got experts that can find any file you deleted on your computer. So technically in order to make sure SOPA/PIPA fully functional you would have to be rid of the internet and get rid of IE and Firefox. That will not happen.

@Dyhalto: I wasn't attacking you. It was not my intention to call you anything, I was just illustrating a point. It's not my fault that you always go off on a tangent with that kind of stuff... This thread is about a bill, and I'm mostly concerned about the language on said bill.

@KingArthur: But for SOPA to really do away with 'Fair Use' it would have to say something like: "We're replacing the Fair Use clause which reads: This, this, this, and that, with: NO FAIR USE FOR YOU!" (Which I'm guessing would be unconstitutional.) But instead the bill reads: "Nothing in this Act shall be construed to impose a prior restraint on free speech or the press protected under the 1st Amendment to the Constitution." Meaning 'Fair Use' still stands and you can use it as a defense if you're dragged to court under a dubious copyright infringement claim... Which again, is something that can already happen, but will most likely remain as rare if the bill ever passes.

Let's go trough it again. I'm sure you're confident enough that the Attorney General has better things to do that go after your FF8 review, right? Well, what you mention probably refers to the section of the bill that goes: "Limited Injunctive Relief in Cases of Counter Notification" (Incidentally, I guess that goes against your own choice of words of "Almost limitless"?) Which is when a copyright holder has the option to file a lawsuit against the site or the people responsible of a site, after they have received a counter notification. But the point is that they still have to go to a court to try anything. It's not like it were that easy as to just point a finger at you and then BAM! You're done.

Lastly, and pointing to the obvious just to be sure... I'm not a lawyer, nor I'm playing to be one online. I'm just genuinely trying to wrap my head around a bill that according to some people will undo the internet and send us into another dark age, among other things. =/

I am NOT a troll account! I was just showing how SOPA was so ridiculously stupid. I'm might have been a little extreme but look at the SOPA law. It is so ridiculously extreme. I would shoot out my hard drive before I let SOPA touch it. Why can't this country and other countries enforce their own laws on their books.

I think they need to not be idiots and compose anti-piracy legislation that doesn't vastly overpower corporations to take legal action against the web. But if they're even half as money-grubbing as I expect they are, I am completely unsurprised these laws are so over-the-top.
Usually these bills are actually written by corporate lobbyists themselves, seeking to entrench or expand their business using legal framework and tax-funded enforcement. All the politicians have to do is "introduce" or "sponsor" the bill.

If you had an elected representative who actually cared about his constituency, the knee-jerk reaction to such legislation would be "GTFO". But money rules the political process. Without any kind of drastic uprise from the citizen population, big business will continue to write and dictate the law of the land.
